Using this website

You may read, print and share anything on this site for personal or internal business use.

The text, the design, the code and the campaign bracket device are ours. Quoting a passage with attribution is welcome; republishing pages wholesale is not.

Prices and figures shown here are accurate at the date of publication and may change. Nothing on this site is a contract or a binding offer.

Commercial terms

These apply to advertising engagements and are set out in full in your agreement. They are published here so that nothing in that agreement is a surprise.

• Month to month. No annual contract. Cancel with 30 days notice.
• Accounts are opened in your name, on your billing, and remain yours if the engagement ends.
• Landing pages and the system that serves them remain Mighty Apes property and do not transfer when the engagement ends.
• Ad spend is paid by you directly to Google, Meta and Yelp. We never take a percentage of it.
• The management fee is the greater of your plan price or 8% of monthly ad spend.
• Fees are billed monthly in advance. Ad spend is billed to you by the platforms on their own cycle.

What we are responsible for

The work: account structure, campaign build, ad copy, landing pages, negative keyword management, conversion and call tracking, and the daily review described on the how it works page.

We do not guarantee a cost per lead, a lead volume, a ranking, a conversion rate or any advertising outcome. Results depend on your market, your competition, your pricing, your reviews and how your business handles the leads it receives, none of which are within our control.

Advertising platforms change their rules, their pricing and their products without notice, and can restrict or suspend accounts for reasons outside our control. We work to prevent that and to resolve it when it happens, but we cannot guarantee the outcome of another company's policy decision.

What you are responsible for

• The accuracy and legality of the claims you ask us to advertise, including any license or certification you state.
• Answering the leads that advertising produces, during the hours your ads run.
• Paying the advertising platforms directly and on time, so that campaigns are not interrupted.
• Giving us the access we need to the accounts and profiles we manage.

Confidentiality

Your account data, your figures and your business information are confidential. We will not publish a case study, a figure or your business name without written permission, which is why the Case Studies page carries only client-approved numbers.

Ending an engagement

Either side can end it with 30 days notice. On the last day we hand over administrative control of every account, landing page and tracking asset, and we export your data rather than holding it.

There is no exit fee and no penalty for leaving. If a provider has to lock you in to keep you, the work was not doing it.

Governing law

These terms are governed by the laws of the State of California, and any dispute arising under them will be handled in the courts of Los Angeles County.
